Crimmigration Clinic applauds Ninth Circuit en banc decision

The Crimmigration Clinic is thrilled to share the recent en banc decision from the Ninth Circuit, which overturns an incorrectly decided case from seven years ago. The decision ensures that noncitizens pursuing forms of immigration relief do not have prior criminal records unfairly manipulated to prevent them from receiving the immigration relief they are entitled to under the law.

The Crimmigration Clinic co-counseled an amicus brief filed in the case on behalf of immigration law professors. The brief argued that the immigration statute’s conviction definition, which is overly broad, should be interpreted so as not to frustrate federalism principles. The Immigrants’ Clinic of Stanford Law School and the Immigrant Defense Project also filed an amicus brief on behalf of immigrants’ rights organizations.
